This Services may include a variety of features, such as discussion forums, blogs, photo- and video-sharing pages, email services and social networking features that allow feedback to us and allow users to interact with each other on the Services and post content and materials for display on the Services. We are not responsible for the speech, content, messages, information or files that you or others may transmit, post or otherwise provide on or through the Services. You understand that we have no obligation to monitor any discussion forums, blogs, photo- or video-sharing pages, or other areas of the Services through which users can supply information or material. However, we reserve the right at all times, in our sole discretion, to screen content submitted by users and to edit, move, delete, and/or refuse to accept any content that in our judgment violates these Terms of Service or is otherwise unacceptable or inappropriate, whether for legal or any other reasons. Classified Advertising
All classified ads are subject to the applicable rate card, copies of which are available from our Advertising Dept. All ads are subject to approval before publication. The Services reserves the right to edit, refuse, reject, classify or cancel any ad at any time. Errors must be reported in the first day of publication.
The Services shall not be liable for any loss or expense that results from an error in or omission of an advertisement. No refunds are due for early cancellation of an order.
When you submit a classified ad for publication on the Services, you agree that the advertisement as it appears on the Services becomes our property and you assign all ownership interest in the advertisement as it appears on the Services under copyright law or otherwise to us. Submission of an advertisement does not constitute a commitment to publish the advertisement, and publication of an advertisement does not constitute an agreement for continued publication. We will accept only standard abbreviations and require proper punctuation. We reserve the right to edit, reclassify, revise, reject or cancel any advertisement at any time, in our sole discretion. Real Estate Advertisements; Equal Housing Opportunity

Our Services may permit users to post, and search for, job openings. We do not knowingly accept listings regarding employment that are not for bona fide job opportunities. The information contained in any company directories that may be provided on the Services is provided for business lookup purposes and is not to be used for marketing or telemarketing applications. Modifications to, or Discontinuation of, the Services
We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services, or any portion thereof, with or without notice. You agree that we will not be liable to you or to any third party for any modification, suspension or discontinuance of the Services or any portion thereof.

TECHCRUNCH MAKES NO WARRANTY THAT TECHCRUNCH WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR ERROR FREE, OR THAT DEFECTS WILL BE CORRECTED. Indemnification

Suspension and Termination of Access
You agree that, in our sole discretion, we may suspend or terminate your password, account (or any part thereof) or use of the Services, or any part of the Services, and remove and discard any materials that you submit to the Services, at any time, for any reason, without notice. You agree that we will not be liable to you or any third-party for any suspension or termination of your password, account (or any part thereof) or use of the Services, or any removal of any materials that you have submitted to the Services. In the event that we suspend or terminate your access to and/or use of the Services, you will continue to be bound by the Terms of Service that were in effect as of the date of your suspension or termination.

Waiver of Certain Rights
No Jury Trial. You and TechCrunch each hereby waive any right to a jury trial of any controversy, claim, counterclaim, or other dispute arising between you and TechCrunch relating to these Terms or our Site (each a “Claim,” and collectively, “Claims”).
No Class Representative or Private Attorney General. Each of you and TechCrunch agree that with respect to any Claim, neither may: (i) act as a class representative or private attorney general; or (ii) participate as a member of a class of claimants. You agree that neither you nor TechCrunch may litigate (or seek to litigate) any Claim on a class or representative basis, and that you and TechCrunch may seek relief only through individual Claims. You and TechCrunch may not consolidate or join (or seek to consolidate or join) any controversy, claim, counterclaim, or other dispute of other persons or parties who may be similarly situated.
Severability/No Waiver/Survival. If any provision of this section (Waiver of Certain Rights) is found to be invalid or unenforceable, that provision will be deemed appropriately modified to give effect to the intent of the provision or, if modification is not possible, will be severed and the remainder of this section will continue in full force and effect. No waiver of any provision of this section will be effective or enforceable unless recorded in a writing signed by the party waiving such a right or requirement. Such a waiver will not waive or affect any other provision of these Terms. This section will survive the termination of your relationship with TechCrunch.
30-Day Opt-Out Right. You have the right to opt out of the provisions of this section by sending, within 30 days after first becoming subject to its terms, written notice of your decision to opt out to the following address: TechCrunch Media, LLC, 9720 Wilshire Boulevard, 6th Floor, Beverly Hills, CA 90212. Your notice must include your name and address, any usernames, each email address you have used to set up an account on the Services, and an unequivocal statement that you want to opt out of this section. You agree that if you opt out of this section, all other parts of these Terms will continue to apply to you. Opting out of this section has no effect on any other agreements that you may currently have, or may enter in the future, with us.
Limitations: This section limits certain rights, including the right to maintain certain court actions, the right to a jury trial, the right to participate in any form of class or representative claim, and the right to certain remedies and forms of relief.
Restrictions
The Services is intended for use only by residents of the United States over the age of 13. It may not comply with legal requirements of foreign countries. Other countries may have laws and regulatory requirements that differ from those in the U.S. By using this Services, you agree to the transfer and processing of any personal information you provide to the U.S. as set forth in the Privacy Policy under the laws of the United States and the State of New York, rather than under the law of your home country.
Miscellaneous
This agreement constitutes the entire agreement between us and you with respect to the subject matter contained in this agreement and supersedes all previous and contemporaneous agreements, proposals and communications, written oral. You also may be subject to additional terms and conditions that may apply when you use the products or services of a third party that are provided through the Services. In the event of any conflict between any such third-party terms and conditions and these Terms of Service, these Terms of Service will govern. This agreement will be governed by and construed in accordance with the laws of the State of New York, without giving effect to any principles of conflicts of law. The failure of TechCrunch to enforce any provision(s) of these Terms or respond to a breach by any party shall in no way waive TechCrunch’s right to subsequently enforce any of these Terms or respond to any breaches.
This agreement is personal to you and you may not assign it or any associated rights hereunder to anyone. Any attempt by you to assign or transfer these Terms, without such consent, will be null and void. If any provision of this agreement is found to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from this agreement and will not affect the validity and enforceability of any remaining provisions. These Terms of Service are not intended to benefit any third party, and do not create any third-party beneficiaries. Accordingly, these Terms of Service may only be invoked or enforced by you or us. You agree that regardless of any statute or law to the contrary, any claim or cause of action that you may have arising out of or related to use of the Services or these Terms of Service must be filed by you within one year after such claim or cause of action arose or be forever barred. The term “including” in these Terms will be interpreted broadly and will mean “including, without limitation.” Titles are for convenience only and will not be considered when interpreting these Terms.
